Real-life case study of a successful dog bite compensation claim

We have a team of lawyers who specialise in claiming dog bite compensation nationwide. Here’s a case study of a case we recently concluded on behalf of a client who had been bitten on the arm in an unprovoked attack.

An individual who had been bitten by a cross breed dog contacted us for legal advice. They had been exercising near their home in Wiltshire when they encountered someone who was out with their dog. The client tried to pass the dog owner by walking around them, but the dog instantly whipped around, jumped up, and bit the client on the arm. In addition to puncture wounds, they suffered a series of deep cuts and bruises to their leg and hip as the dog clawed up their body during the attack.

After receiving hospital treatment, our client reported the incident to the police. This report prompted the authorities to order the dog owner to attend a behaviour correction course.

Our client tried to contact the dog owner directly about compensation, but the owner ignored their communications. Our team therefore received a request for advice, and we agreed to make a compensation claim on the injured person’s behalf.

We sent a formal Letter of Claim to the dog owner, which outlined their negligence in failing to exercise sufficient control over their dog and a failure to restrain it. The dog owner had also failed to warn our client of the potential danger of their dog.

They admitted liability for the incident, and we commissioned expert medical reports from a plastic surgeon and a psychologist to establish the impact of the injuries on our client.

The psychologist confirmed our client suffered from stress symptoms such as flashbacks, nightmares, and increased wariness around dogs, and that the attack directly caused this. The expert plastic surgeon concluded that our client had been left with scars on their arm and thigh which have now become numb and tough when touched.

We disclosed both reports to the Defendant, along with a Schedule of Loss that documented our client’s financial losses incurred as a result of the incident. After a short negotiation period, the defendant settled the dog bite compensation claim out of court for a five-figure sum.
